3. Reservations and Payments
All reservations are subject to availability and confirmation.

6. Guest Responsibilities

• Follow instructions provided by guides, drivers, and tour operators;

• Treat employees, vendors, and other guests respectfully;

• Wear appropriate attire for selected activities;

• Notify the Company of relevant health conditions that may affect participation.

Failure to comply may result in removal from the tour without refund.

7. Health, Safety, and Fitness
Certain activities may involve physical exertion, including:

• Walking;

• Hiking;

• Swimming;

• Climbing;

• Water sports;

• Adventure excursions.

Guests are solely responsible for determining whether they are physically fit to participate.

Participants with medical conditions, disabilities, allergies, or mobility limitations are encouraged to notify the Company before booking.

Danny's Jamaican Tours LLC reserves the right to decline participation in activities where safety concerns exist.

8. Assumption of Risk
Travel, transportation, outdoor recreation, and adventure tourism involve inherent risks that cannot be eliminated entirely.

By participating in any Company-sponsored activity, guests knowingly and voluntarily assume all risks associated with:

• Transportation;

• Water-related activities;

• Outdoor environments;

• Weather conditions;

• Wildlife encounters;

• Equipment use;

• Slips, trips, falls, injuries, illness, or death.

Participation is entirely voluntary.

9. Limitation of Liability
To the fullest extent permitted by law, Danny's Jamaican Tours LLC, its members, officers, employees, contractors, affiliates, agents, and representatives shall not be liable for:

• Personal injury;

• Illness;

• Death;

• Delays;

• Missed flights or cruise departures;

• Property damage;

• Lost or stolen belongings;

• Service interruptions;

• Acts or omissions of third-party suppliers;

• Events beyond the Company's reasonable control.

The Company's total liability for any claim shall not exceed the amount paid by the customer for the specific service giving rise to the claim.

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

10. Third-Party Operators
Certain excursions, attractions, and transportation services may be provided by independent third-party suppliers.
Danny's Jamaican Tours LLC acts as an intermediary in arranging such services and is not responsible for:

• Third-party negligence;

• Equipment failures;

• Service delays;

• Vendor operational decisions;

• Acts or omissions of independent contractors.

Guests may be required to sign additional waivers required by third-party operators.

11. Travel Documents
Guests are responsible for obtaining and maintaining all required:

• Passports;

• Visas;

• Travel authorizations;

• Health documentation;

• Insurance documentation.

Failure to obtain proper documentation does not entitle a customer to a refund.

12. Travel Insurance
Danny's Jamaican Tours LLC strongly recommends that all guests purchase comprehensive travel insurance covering:

• Trip cancellation;

• Medical expenses;

• Emergency evacuation;

• Lost baggage;

• Flight delays;

• Weather disruptions.

Travel insurance is the sole responsibility of the guest.

13. Photography and Media Release
The Company may take photographs and videos during tours for marketing and promotional purposes.
By participating, guests grant Danny's Jamaican Tours LLC a non-exclusive, royalty-free right to use photographs and video footage containing their image for:

• Website content;

• Social media;

• Advertising;

• Marketing materials.

Guests who do not wish to be photographed should notify the Company in writing before the tour begins.

14. Minors
Guests under eighteen (18) years of age must be accompanied by a parent, guardian, or authorized adult.

The supervising adult assumes full responsibility for the minor's conduct, safety, and participation.

15. Prohibited Conduct
The Company reserves the right to deny service or remove any participant without refund for:

16. Force Majeure

• Pandemics;

• Public health emergencies;

Where feasible, the Company may offer rescheduling, credits, or alternative arrangements.

17. Intellectual Property
All website content, including but not limited to:

• Logos;

• Trademarks;

• Graphics;

• Text;

• Images;

• Videos;

• Marketing materials; remains the exclusive property of Danny's Jamaican Tours LLC.

Unauthorized use, copying, distribution, or reproduction is prohibited without written permission.

18. Privacy

19. Dispute Resolution
Informal Resolution
Before initiating arbitration or legal proceedings, customers agree to contact Danny's Jamaican Tours LLC and attempt to resolve disputes informally.

19 a) Binding Arbitration

• Permit participation remotely by video conference when practical.

The arbitrator may award remedies available under applicable law but may not award punitive damages except where required by law.

19 b) Small Claims Exception
Either party may pursue qualifying claims in an appropriate small claims court.

19 c) Class Action Waiver
To the fullest extent permitted by law, all disputes must be brought on an individual basis.
Customers waive the right to participate in:

• Class actions;

• Collective actions;

• Representative actions;

• Private attorney general actions.

No arbitration shall be combined with another customer's claim.
Limitation Period

Any claim against Danny's Jamaican Tours LLC must be filed within one (1) year from the date the claim arises unless a longer period is required by applicable law.

19 d)Attorney Fees
Each party shall bear its own legal expenses unless otherwise awarded by the arbitrator or required by law.

20. Governing Law
These Terms and Conditions shall be governed by and interpreted under the laws of the State of Arkansas, United States, without regard to conflict-of-law principles.
Nothing in these Terms limits mandatory consumer rights available under applicable United States, Arkansas, or Jamaican law.

21. Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.

22. Changes to Terms and Conditions
